My name is Robert Neil Clark, and I have a story to tell concerning dozens of Credit Report errors that I have suffered with for almost 12 years. These errors date back to "atleast" January 1994. This is when I discovered the first error (a R9) and informed Equifax of the problem. These problems re-appeared in 1995, 1996, 1997, 1998, 2000 and the fall-out hasn't stopped yet in 2005.

The evidence leads back to some very "fishy" circumstances that confuse me into not knowing whether this was "mistaken Identity" or "Identity Theft". There are many more confusing questions regarding many of the participants involved in this case.

Erroneous Verdict inaccuarately portrays the lies & cover-up!
Consumers need to check their credit report, Now! I have been fighting for more then 10 years to clear up too many eroneous credit problems that Scotiabank finally admitted its failure in their reporting accuracy to the credit bureau.

These errors consisted of several R9's, I9's, duplicate accounts, extra accounts, inacurrate debt amounts, unknown inquiries, unapproved inquiries, improper investigations, misleading conversations, untruths in their explainations, passed on and on through several Equifax respresentatives. Not to mention, the several 45+ minutes hold times during phone calls, and more....

Equifax was faulted for not responding for several years to my complaints! This directly reflected on me through the Royal Bank and CIBC Bank, both calling me a liar and TD Canada Trust having a negative comment about my credit history attached to their computer file.

These Big Business companies have stolen my identity for over 10 years and that has seriously disrupted my life, my family, my finances, my business, my partners, and my friends. We need tougher legislation against Banks and Credit Bureaus to prevent errors from stealing our identity and destroying our lives.

UPDATE : April 26 2005

I have loss the verdict on cost and now these problems I have endured over the past 11+ years will cost me well over $100,000.00 for the mistakes, lies, misrepresenting of evidence and cover-up by both Equifax and Scotia Bank. Not to mention the discrimination I recieved from both of the defendants, Justice Day and his version of our Judical System, along with the Royal Bank, the CIBC Bank, TD Bank, the former Canada Trust and several credit card companies (i.e. CIBC Visa, Scotia Visa, Capital One M/C, CitiBank M/C, and MBNA M/C). Since Equifax was not fixing the problems over the years, I tried to outrun the credit report errors. But they caught up to me everywhere, and everytime they became worse and worse. ALL errors have been PROVEN NOT to belong to ME.

I suffered through this for 7 years before bringing this to a lawyer and now 5 years later I have very little answers to my questions.
I did win a judgement for lack of duty on the behalf of the defendants. Both defendants were penalized a measly $5,000.00 each which was awarded to me, but I have not yet seen! This is totally unbelievable and very upsetting that our Judical System did not respect my rights and freedoms. I could not talk about the entire case and all the people involved. I could not display all the evidence needed to represent my case. I could not have certain pieces of evidence or specific witnesses I requested. And now, Justice Day is punishing me for taking this case to court. My losses and costs in the past 11+ years dealling with this fiasco outweigh the awardment by approxiamatly 15:1.

Once again our Judical System with Justice Day, protected the Big Businesses from internal corruption and public embarrasement, and turned back onto us, the little people, who will suffer at the hands of these corporations, their lawyers and their judges. It was in the early stages of my case vs Equifax and Scotiabank, that we started seeing and hearing commericial about our credit reports and to check them for errors. Equifax commerical campaign started shortly after their intial response of defense to my litigation. And it was Scotiabank that first had a deal with Equifax to give out online credit reports via internet a year later. I would consider this more then just coincidental. These are happening because of the problems they released on me.

I have not yet mentioned the mental and physical stress this has created i.e. embarassement, anger, depression, physical and mental exhaustion, the poor health and mental break down...
